He remembers seeing ads for those brands in Jet, a once-popular national magazine for Blacks. “I understand this issue from the perspective of a Black man who witnessed the effects of the predatory marketing of mentholated cigarettes in my own community,” he says. Black people’s disproportionate use of menthol cigarettes and high rates of smoking-related illness have been in the spotlight since the federal government recently announced a proposal to ban menthol cigarettes. The U.S. Food and Drug Administration says it wants to ban menthol cigarettes in part because the tobacco industry has aggressively marketed these tobacco products to African-Americans. The FDA says about 85% of Black smokers use menthol cigarettes compared to 30% of whites. Blacks die of smoking-related illnesses at higher rates than whites. Tobacco use is a major contributor to the three leading causes of death among Blacks – heart disease, cancer and stroke. The FDA says banning menthol cigarettes could prevent 237,000 deaths among African-Americans. The process of banning the sale and manufacture of menthol cigarettes could take years. That’s because the FDA must draft proposed regulations, then invite and consider public comments. The tobacco industry is expected to aggressively fight the proposed ban. In the meantime, New York is considering legislation that would ban the sale of menthol cigarettes statewide. Massachusetts and California have already done that. Some studies say menthol makes it easier to smoke and harder to quit. R.J. Reynolds, which makes Newport, the best-selling menthol brand, disagrees. The company said in a statement, “the published science does not support regulating menthol cigarettes differently from non-menthol … nor does it support that menthol cigarettes adversely affect initiation, dependence or cessation.” Dykes, who smoked Newports, said he made six attempts to give up smoking before he quit for good. “It was a full-fledged addiction,” he said. “I would tell my family I quit smoking, then sneak outside and smoke a cigarette, and come back inside, just oblivious to the fact they could smell it on me.” Anti-smoking and public health groups have been trying to get menthol banned for years. But the American Civil Liberties Union and some other civil rights groups oppose the proposed ban. In a recent letter to the FDA, the ACLU and other groups said: “Such a ban will trigger criminal penalties, which will disproportionately impact people of color, as well as prioritize criminalization over public health and harm reduction. A ban will also lead to unconstitutional policing and other negative interactions with local law enforcement.” The FDA, however, said any ban will only address manufacturers, distributors and retailers. “The FDA cannot and will not enforce against individual consumer possession or use of menthol cigarettes or any tobacco product,” the agency said in a statement. Dykes said he would like to see menthol cigarettes banned because smoking is one of the worst public health problems in the Black community. “There is no credible argument why the FDA should allow these products to continue to be marketed,” he said. “They are incredibly dangerous.” James T.
